These Terms of Service ("Terms") govern your access to and use of this Openform instance (the "Service"). Openform is open-source, self-hostable form-builder software that lets people create forms and surveys, share public links to them, and collect responses. This particular instance is operated and made available to you by the instance operator.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
By creating an account, accessing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced within them, including the Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to that organization.
You must be old enough to form a binding contract in your jurisdiction to use the Service. The Service is not directed at children, and accounts may not be created by anyone below the minimum age required by applicable law.

The operator may add, change, or remove functionality at any time. The Service is provided on an "as available" basis, and no guarantee is made that it will be uninterrupted or error-free.

You are responsible for the forms you create, the way you distribute them, and the responses you collect through them. You are also responsible for ensuring that your use of the Service, including any collection of personal data from respondents, complies with all laws and regulations that apply to you.
Within a workspace, account holders may share access to forms and responses with other members. You are responsible for who you invite to your workspaces and for the level of access you grant them.

"Your content" includes the forms and surveys you create, their definitions and configuration, and the responses you collect through them. As between you and the instance operator, you retain all rights you hold in your content. These Terms do not transfer ownership of your content to the operator.
You grant the instance operator the limited rights necessary to host, store, process, display, and transmit your content for the purpose of operating and providing the Service to you. This permission exists only to run the Service and does not grant the operator any independent right to use your content for unrelated purposes.
You are solely responsible for your content and for the legality of collecting and processing it. You represent that you have all rights necessary to submit your content and to authorize its processing through the Service.
When someone responds to a form, the response becomes part of the content associated with the form's owner and workspace. If you are an account holder collecting responses, you act as the party responsible for that data toward your respondents and must handle it in accordance with applicable law, including honoring respondent requests where the law requires it.
If you send suggestions or feedback about the Service, the operator may use them without restriction and without obligation to you.
The Service can integrate with third-party identity providers (such as Discord and Roblox) to let account holders or respondents sign in and, where applicable, to capture identity information such as a username, a user identifier, or group or guild role membership. When you sign in through one of these providers, your use of that provider is governed by the provider's own terms and privacy policy, not these Terms.
The instance operator does not control third-party providers and is not responsible for their availability, accuracy, security, or practices. Enabling or using a third-party integration is at your discretion, and any changes a provider makes to its service may affect the corresponding functionality of the Service.
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The instance operator does not warrant that the Service will be uninterrupted, secure, timely, or error-free, that defects will be corrected, or that any data will be preserved or free from loss. You are responsible for maintaining your own backups of content that is important to you. Any material obtained through use of the Service is accessed at your own discretion and risk.
To the fullest extent permitted by law, in no event will the instance operator, or anyone involved in creating or providing the Service, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.
To the fullest extent permitted by law, the total aggregate liability of the operator arising out of or relating to the Service will not exceed the greater of the amount you paid, if any, to use the Service during the three months preceding the event giving rise to the claim, or a nominal sum where no payment was made. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
You may stop using the Service at any time. Where the functionality is available, you may delete your account and content directly; otherwise you may request that the instance operator do so.
The instance operator may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, including if the operator believes you have violated these Terms, to protect the Service or its users, or to comply with law. The operator may also stop operating the instance entirely.
Upon termination, your right to use the Service ends. Depending on how the instance is configured, your content may be deleted following termination. Provisions of these Terms that by their nature should survive termination, including ownership, disclaimers, limitation of liability, and any indemnities, will survive.
The instance operator may revise these Terms from time to time. When changes are made, the "Last updated" date above will be revised. Material changes may be communicated through the Service where practicable. Your continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
These Terms are governed by the laws of the operator's jurisdiction, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the courts having jurisdiction in that location, unless applicable mandatory law provides otherwise.
